1. Definitions and Scope

In these Terms, "BooksyGo.com," "we," "our," or "us" means the operator of the BooksyGo.com booking platform. "You" or "your" means the person making the booking and any travelers included on that booking.

These Terms apply to your access and use of BooksyGo.com, together with our Privacy Policy and Cookie Policy. By using our platform, you agree to these Terms.

3. Eligibility and Booking Authority

By making a booking, you confirm that:

• You are at least 18 years old and legally capable of entering contracts
• You are authorized to act for all travelers on the booking
• All information submitted is true, complete, and accurate
• You accept responsibility for payment obligations, amendments, and cancellation charges

4. Platform Role and Service Description

BooksyGo.com provides an online platform to search accommodations, compare offers, make reservations, and manage booking information.

We act as an intermediary between you and third-party accommodation providers and related suppliers. Unless expressly stated otherwise, we are not the owner or operator of listed accommodations and are not a party to on-property service delivery.

5. Booking Process and Confirmation

• A booking request is an offer to purchase travel services
• Your booking is confirmed once confirmation details are issued to you by email
• You must review booking details immediately and report errors without delay
• We may communicate booking updates with the lead traveler only

6. Prices, Taxes, and Additional Charges

• All prices are displayed in the selected currency
• Quoted prices may include taxes and fees shown at checkout
• Some local taxes, resort fees, and property surcharges may be payable at the accommodation
• Currency conversions shown on the platform are indicative and may differ from card issuer rates
• Bank, card network, or processor fees may apply and are your responsibility

7. Payment, Authorization, and Fraud Controls

• By submitting payment, you authorize us and our payment partners to process your transaction
• Payments are processed through secure payment infrastructure
• We may conduct fraud and risk checks before or after booking confirmation
• We may suspend, reject, or cancel bookings with elevated fraud risk or unauthorized payment signals

8. Modifications Requested by You

Modification requests are subject to accommodation provider rules, availability, and fare conditions.

• Changes may result in price differences and/or service fees
• Some changes may require cancellation and rebooking
• Urgent amendment requests should be sent to vip.support@nuitee.com

9. Cancellations, No-Show, and Refunds

Cancellation rights depend on the specific rate and property policy selected at booking.

• Refundable and non-refundable conditions are shown before you confirm your booking
• No-show or late cancellation may result in up to 100% charge per the booked policy
• Where refunds are due, timelines depend on provider/payment channel processing
• Cancellation assistance requests can be sent to vip.support@nuitee.com

10. Changes or Cancellations by Us

We may need to change or cancel a booking in limited circumstances, including supplier constraints, operational issues, legal requirements, or force majeure events.

• When possible, we will offer alternatives or applicable refunds
• Our obligations are limited by supplier terms and applicable law
• Force majeure events may limit available remedies

11. User Conduct and Accommodation Rules

The following actions are strictly prohibited. You must not:

• Use the platform for any illegal purpose
• Make fraudulent bookings or provide false information
• Interfere with the platform's operation or security
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Scrape, copy, or reproduce content without permission
• Use automated systems to access the platform
• Post harmful, offensive, or inappropriate content

You are responsible for your conduct and for any property damage or extra charges incurred by your travel party during a stay.

12. Travel Documents, Health, and Insurance

You are responsible for ensuring all travelers hold valid passports, visas, permits, vaccinations, and other required travel documents.

We strongly recommend obtaining suitable travel insurance. Insurance is not automatically included unless expressly stated.

13. Complaints and Claims Procedure

If you encounter an issue during your stay, notify the accommodation provider immediately and contact us as soon as possible at vip.support@nuitee.com.

To help us investigate, submit supporting documents promptly, including booking references and relevant evidence.

14. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, BooksyGo.com is not liable for indirect, incidental, punitive, or consequential losses. We do not guarantee uninterrupted platform availability or error-free third-party content and inventory.

Our total liability for claims arising out of or connected with a booking will generally be limited to the amount paid by you for that booking, except where a higher liability is required by applicable law.

15. Indemnity

You agree to indemnify and hold BooksyGo.com and its affiliates harmless against third-party claims, liabilities, damages, and costs (including reasonable legal fees) arising from your breach of these Terms, misuse of the platform, or unlawful conduct.

16. Intellectual Property and Platform Use

All platform content, trademarks, branding, software, and materials are owned by BooksyGo.com and/or its licensors and are protected by intellectual property laws.

You may not copy, scrape, reverse engineer, reproduce, or commercially exploit platform content without prior written permission.

17. Privacy and Communications

Personal data is processed according to our Privacy Policy. By using the platform, you acknowledge that we may communicate booking-related notices by email, SMS, or phone where appropriate.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

19. Binding Arbitration and Class-Action Waiver

Please read this section carefully. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, your booking, or your use of BooksyGo.com will be resolved by final and binding arbitration on an individual basis, and not in court, except as specifically provided below.

• No class actions: You and BooksyGo.com agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general proceeding.
• No jury trial: You and BooksyGo.com waive any right to a jury trial for covered disputes.
• Arbitration rules: Arbitration will be administered by the American Arbitration Association (AAA) under applicable consumer arbitration rules in effect at the time the claim is filed.
• Small claims carve-out: Either party may bring an individual action in small claims court if the claim qualifies and remains in that court.
• Injunctive relief carve-out: Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property misuse or unauthorized access to systems/data.
• Severability for class waiver: If the class-action waiver is found unenforceable for a particular claim, that claim must proceed in court, but all other claims remain subject to arbitration.

Before starting arbitration, you agree to first contact vip.support@nuitee.com and attempt to resolve the dispute informally.

20. Assignment, Severability, and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Failure to enforce a provision is not a waiver. We may assign these Terms in connection with a corporate transaction or reorganization.

21. Changes to These Terms

We may update these Terms from time to time. Material updates will be posted on this page with a revised "Last Updated" date. Continued use of BooksyGo.com after updates indicates acceptance of the revised Terms.
